Terms of service

Last Updated: September 24, 2026

These Terms of Service (“Terms”) govern your access to and use of the SHARK website, products, services, and related offerings (collectively, the “Services”).

By accessing our website, placing an order, submitting payment, approving artwork, or otherwise using our Services, you agree to these Terms. If you do not agree to these Terms, you should not use the Services or place an order.

1. ORDERS AND ACCEPTANCE

All orders are subject to acceptance by SHARK.

Submission of an order, quote request, purchase order, payment, or other request does not obligate SHARK to accept or fulfill the order.

SHARK reserves the right, to the extent permitted by law, to reject or cancel an order due to pricing errors, product availability, production limitations, suspected fraud, inaccurate information, prohibited content, technical errors, or other legitimate business reasons.

If SHARK cancels an order before production for reasons unrelated to a customer's breach or conduct, amounts paid for the canceled portion of the order will be refunded as appropriate.

2. PRICING AND PAYMENT

Prices are displayed in U.S. dollars unless otherwise stated.

Prices, products, specifications, availability, promotions, and other website information may change without notice.

Applicable taxes, shipping charges, delivery fees, installation charges, permits, engineering fees, surveys, inspections, or other third-party expenses may be charged separately unless expressly included in writing.

Orders must be paid according to the payment terms provided at checkout, on an invoice, or in a written quotation.

SHARK may suspend production, fulfillment, delivery, or other Services while an amount remains unpaid.

3. CUSTOM AND MADE-TO-ORDER PRODUCTS

Many SHARK products are custom printed, fabricated, personalized, or otherwise manufactured specifically for the customer.

Once an order enters production, materials are ordered or prepared, fabrication begins, printing begins, or other customization has commenced, the order generally cannot be canceled, changed, returned, or refunded, except where required by applicable law or expressly provided under our No Refund Policy.

Changes requested after production begins may require additional charges and may affect the estimated completion date.

4. ARTWORK AND CUSTOMER APPROVAL

Customers are responsible for carefully reviewing all artwork, proofs, dimensions, spelling, grammar, phone numbers, addresses, QR codes, colors, quantities, materials, finishes, orientation, positioning, and other specifications before approval.

Approval of artwork or a proof constitutes authorization for SHARK to proceed with production based on the approved information.

SHARK is not responsible for errors contained in customer-supplied artwork or information or errors visible in artwork or proofs that the customer approved.

Changes requested after approval may result in additional design, setup, material, production, or other charges.

5. CUSTOMER-SUPPLIED FILES

Customers are responsible for supplying artwork and files of sufficient quality and resolution for the intended product.

Low-resolution images, compression, incorrect color profiles, missing fonts, transparency issues, improperly prepared files, or other file-related problems may affect the finished product.

SHARK may identify apparent problems as a courtesy but is not obligated to discover or correct every defect in customer-supplied artwork.

6. COLOR AND PRODUCTION VARIATIONS

Colors displayed on monitors, phones, tablets, and other digital devices may differ from the colors of a finished physical product.

Printing, fabrication, materials, lighting, substrates, manufacturing processes, and production batches may produce reasonable variations in color, texture, finish, dimensions, positioning, appearance, or other characteristics.

Such reasonable industry and manufacturing variations do not constitute defects.

Where precise color matching is important, customers should request applicable color-matching options before production.

7. DIMENSIONS, MEASUREMENTS AND FIT

Unless SHARK has expressly agreed in writing to perform field measurements or site verification, customers are responsible for the accuracy of all dimensions and measurements supplied to SHARK.

SHARK is not responsible for products that do not fit or function as intended because of inaccurate, incomplete, or incorrect measurements, specifications, site information, or other information supplied by the customer or a third party.

Customer-requested modifications, remakes, or replacements resulting from incorrect customer-supplied measurements may be charged as a new order.

8. PRODUCTION AND TURNAROUND TIMES

Any turnaround, production, fabrication, shipping, or delivery time displayed or communicated by SHARK is an estimate unless SHARK expressly agrees in writing to a guaranteed deadline.

Production time generally begins only after all required payment, usable artwork, specifications, approvals, and other required information have been received.

Delays caused by artwork revisions, customer approvals, material availability, carriers, weather, equipment issues, permitting, inspections, governmental authorities, suppliers, or circumstances reasonably outside SHARK's control may extend completion or delivery times.

SHARK is not responsible for consequential losses resulting from a delay except to the extent such liability cannot legally be excluded.

9. SHIPPING AND DELIVERY

Customers are responsible for providing a complete and accurate delivery address.

Delivery dates supplied by carriers or SHARK are estimates unless expressly guaranteed in writing.

Risk relating to shipping and responsibility for loss or damage will be determined according to applicable law and the shipping arrangement used for the order.

Customers should inspect shipments promptly upon receipt and report visible shipping damage or missing items as soon as reasonably possible.

Customers may be required to retain packaging and provide photographs or other documentation necessary to process a carrier or product claim.

10. INSTALLATION

Unless installation is expressly included in the written order, SHARK's obligation is limited to producing and/or supplying the ordered products.

Installation performed by a customer, contractor, sign installer, electrician, property owner, or other third party is outside SHARK's control.

SHARK is not responsible for damage or failure resulting from improper installation, misuse, unauthorized modification, unsuitable mounting conditions, improper electrical work, failure to follow installation instructions, or work performed by unaffiliated third parties.

11. PERMITS, CODES AND PROPERTY APPROVALS

Unless expressly included in SHARK's written scope of work, customers are responsible for determining and obtaining all necessary landlord approvals, property-owner approvals, permits, licenses, zoning approvals, electrical approvals, engineering approvals, and other governmental or third-party authorizations.

The customer's purchase of a product does not constitute a representation that the product is permitted at a particular location.

Requirements may vary by jurisdiction, property, building, and installation method.

12. ELECTRICAL AND ILLUMINATED PRODUCTS

Electrical products and illuminated signage should be installed and connected by appropriately qualified professionals where required.

Customers and installers are responsible for ensuring that installation complies with applicable electrical, building, fire, zoning, and other requirements.

Damage resulting from improper wiring, incorrect voltage, unauthorized modification, improper installation, or other misuse is not considered a manufacturing defect.

13. CUSTOMER CONTENT AND INTELLECTUAL PROPERTY

Customers represent that they own, license, or otherwise possess all rights necessary to use any artwork, photographs, logos, trademarks, text, designs, names, or other materials submitted to SHARK.

By submitting content to SHARK, the customer grants SHARK the limited rights reasonably necessary to reproduce, modify, prepare, print, fabricate, process, and otherwise use the content solely as necessary to provide the requested Services.

Customers are responsible for claims arising from materials they provide to SHARK that infringe or violate the rights of another person or entity.

SHARK reserves the right to reject content that it reasonably believes may be unlawful, infringing, fraudulent, or otherwise inappropriate for production.

14. SHARK INTELLECTUAL PROPERTY

Unless otherwise stated, SHARK's website content, original graphics, branding, logos, layouts, photographs, product presentations, written materials, and other proprietary content are owned by or licensed to SHARK and are protected by applicable intellectual-property laws.

Nothing in these Terms transfers ownership of SHARK's intellectual property to the customer.

15. RETURNS, REFUNDS AND CANCELLATIONS

Returns, refunds, cancellations, replacements, and defective-product claims are governed by SHARK's No Refund Policy, which is incorporated into these Terms by reference.

Because custom products are manufactured specifically for individual orders, custom and personalized products generally cannot be returned or refunded merely because the customer changes their mind, no longer needs the product, or approved incorrect information.

Nothing in these Terms limits any non-waivable rights provided by applicable law.

16. DEFECTIVE OR INCORRECT PRODUCTS

If a product is defective, damaged, or materially inconsistent with the approved order specifications, the customer should promptly contact SHARK with the order number, description of the issue, and photographs or other reasonably requested documentation.

SHARK may inspect or request return of the affected product before determining an appropriate remedy.

Where legally permitted and appropriate to the circumstances, SHARK may elect to repair, reproduce, replace, or refund the affected portion of an order.

17. CHARGEBACKS AND PAYMENT DISPUTES

Customers should contact SHARK promptly regarding legitimate order or billing concerns so that SHARK has a reasonable opportunity to investigate and address the matter.

Initiating a chargeback does not eliminate contractual payment obligations for products or Services properly provided.

SHARK reserves the right to provide payment processors, banks, card issuers, or other financial institutions with order records, approvals, correspondence, delivery confirmation, production records, and other information reasonably necessary to respond to a payment dispute.

Nothing in this section limits a customer's lawful rights under applicable payment or consumer-protection laws.

18. THIRD-PARTY SERVICES

SHARK may rely on third parties for services including payment processing, shipping, fulfillment, hosting, communications, analytics, and other business operations.

SHARK is not responsible for the independent acts, omissions, policies, availability, or performance of third parties except to the extent responsibility cannot legally be excluded.

19. WARRANTIES

Except for warranties expressly provided by SHARK in writing and warranties that cannot legally be excluded, the Services and products are provided on an “as available” basis.

To the maximum extent permitted by applicable law, SHARK disclaims implied warranties to the extent they may lawfully be disclaimed, including implied warranties of merchantability and fitness for a particular purpose.

This section does not affect warranties or consumer rights that cannot be waived or excluded under applicable law.

20. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, SHARK will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost revenue, lost business opportunities, loss of goodwill, or similar losses arising from the use of our products or Services.

To the maximum extent permitted by applicable law, SHARK's aggregate liability arising from a particular order will not exceed the amount actually paid to SHARK for the product or Service giving rise to the claim.

These limitations do not apply where liability cannot legally be limited or excluded.

21. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless SHARK and its owners, officers, employees, contractors, and agents from third-party claims, damages, liabilities, losses, and reasonable costs arising from:

  • Content, artwork, trademarks, photographs, or other materials you provide;
  • Your infringement or violation of another person's rights;
  • Your unlawful use of the Services;
  • Your material breach of these Terms; or
  • Installation, alteration, or use of products contrary to applicable instructions or law where performed by you or parties under your control.

This provision does not require you to indemnify SHARK for liability caused by SHARK's own conduct to the extent such an obligation is prohibited by applicable law.

22. FORCE MAJEURE

SHARK will not be responsible for delays or failures caused by circumstances reasonably beyond its control, including severe weather, natural disasters, fires, transportation disruptions, carrier delays, labor disruptions, governmental actions, utility failures, supply shortages, equipment failures, widespread network outages, or similar events.

23. WEBSITE INFORMATION AND ERRORS

We attempt to provide accurate product descriptions, pricing, specifications, photographs, and other information.

However, typographical errors, pricing errors, technical errors, inaccuracies, or omissions may occasionally occur.

To the extent permitted by law, SHARK may correct errors and update information. If a material error affects an order that has already been placed, SHARK will address the affected order in accordance with applicable law.

24. PROHIBITED USES

You may not use our website or Services to violate applicable law, infringe intellectual-property rights, distribute malicious software, interfere with website security, engage in fraudulent activity, impersonate another person, collect information unlawfully, or otherwise misuse the Services.

SHARK may restrict or terminate access for violations of these Terms.

25. GOVERNING LAW

These Terms and transactions with SHARK will be governed by the laws of the State of New York, without regard to conflict-of-law principles, except where applicable law requires otherwise.

26. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent legally permitted, and the remaining provisions will remain in effect.

27. NO WAIVER

SHARK's failure to enforce any provision of these Terms does not constitute a waiver of that provision or SHARK's right to enforce it later.

28. ENTIRE AGREEMENT

These Terms, together with applicable quotations, invoices, order confirmations, approved artwork, the Privacy Policy, No Refund Policy, and other policies expressly incorporated into an order, constitute the agreement between SHARK and the customer regarding the applicable Services.

If a separately signed written agreement expressly conflicts with these Terms, the signed agreement controls with respect to that conflict.

29. CHANGES TO THESE TERMS

SHARK may update these Terms from time to time. Changes will be posted on this website with an updated revision date.

Changes will apply prospectively except where otherwise permitted or required by law.
